  2. that has read and accepts these General Conditions.

It is a necessary requirement for the purchase of the products offered on Dlived.com that customers read and accept the "TERMS AND CONDITIONS" listed below. The use of our services, as well as the purchase of our products, implies that the customer has read and accepted the "TERMS AND CONDITIONS".

All purchases and transactions made through Dlived.com are subject to a verification and confirmation process, which may include checking the stock and availability of products, validating the payment method, and ensuring compliance with the conditions required by the selected payment method.

VALIDATION: Our VALIDATION method is an effective way to ensure that customers are who they say they are when executing certain transactions, primarily for high-risk purchases and age-restricted sales.

Dlived.com reserves the right to change or update information and correct errors, inaccuracies, or omissions at any time without prior notice. By continuing to access or use our service once any modification takes effect, you agree to be bound by the modified terms. If you do not accept the new terms, in whole or in part, please cease using the Digital Store Dlived.com and the SERVICE.

 Account egistration

For the purchase of products and/or services, CLIENT registration is required by providing accurate personal information and defining a password.

Once registered on the site, the CLIENT is fully responsible for any type of activity or operation that may be carried out with their username and password, including unauthorized use of their credit card.

The CLIENT may choose and change the access password to their account at any time, in case they have registered and it is necessary for the purchase of any of our products. Dlived.com does not assume responsibility in the event that the password is given to third parties.

If for any reason the veracity of the data provided by the CLIENT is found to be lacking, they will be immediately removed from the user community of Dlived.com.

The information you provide for your registration on Dlived.com is transmitted over a secure connection that ensures confidentiality. The CLIENT authorizes the automated processing of this information for authentication on the site, the personalization of the service, which also includes information to the CLIENT about new product offers available on the site, as well as for statistical and/or commercial prospecting purposes, via email or other means.

Rescission

We can terminate or suspend your ACCOUNT immediately, without prior notice and without any conditions, for any reason, including but not limited to, if you violate the "TERMS AND CONDITIONS" set forth.

Upon termination, your right to use the SERVICE will cease immediately. If you wish to cancel your ACCOUNT, you can simply discontinue the use of the service.

Order

The CLIENT may select one or more products from the different categories offered on Dlived.com and review their selection before making the payment. Once the payment is made, they will not be able to modify their purchase. They will receive an email acknowledging receipt of their order, "ORDER CONFIRMATION." Additionally, we will inform them via email when the product is being shipped, "SHIPPING CONFIRMATION."

In any case, in the event of total or partial unavailability of the products after the "ORDER" has been placed, you will be informed via email as soon as possible in order to proceed with the cancellation of the "ORDER".

In case of total cancellation of the order:
  • No charges will be made to your bank account.
  • The "CUSTOMER SERVICE" of Dlived.com will contact YOU to inform you of the cancellation of your ORDER and offer you the possibility to renew it, with the exception of the unavailable PRODUCT.
  • Notwithstanding the REQUESTS made by the CUSTOMER, Dlived.com may at any time modify the range of products offered for sale in the digital store, especially as a result of restrictions related to the availability of these.

Purchase restrictions

Dlived.com will exercise its right to indefinitely block the CLIENT that is found to be attempting to violate our restrictions.

Dlived.com reserves the right to refuse or cancel for legitimate reasons any ORDER in which the number of products or the amount to be paid (for a single ORDER or for several accumulated ORDERS) or other elements clearly and credibly indicate that the CUSTOMER is not a consumer or demonstrate the CUSTOMER's engagement in an economic activity related to the requested products or, in general, any ORDER not authorized in accordance with the applicable legislation in the destination of the purchase.

Promotions

It is possible that all PROMOTIONS available through the SERVICE are subject to rules independent of these TERMS.

If the CLIENT participates in any PROMOTION, please review the relevant rules and “OUR PRIVACY POLICY.” If the rules for a PROMOTION conflict with these TERMS, the PROMOTION rules will take precedence.

Use of the site

By using Dlived.com and placing orders through it, the CLIENT declares:
  • Be over 18 years old and have the legal capacity to enter into contracts.
  • Your email address, postal address, and other contact details accurately reflect reality. Likewise, you consent that we may use this information to contact you if necessary. If you do not provide us with all the information we need, we will not be able to process your order.
  • Use this website only to make legally valid inquiries or purchases.
  • Do not place any false or fraudulent orders.
  • Do not place any of our products on another platform or any other digital medium and offer them for redistribution or resale of any kind.

Privacy

Dlived.com is the owner of the database generated with the personal information voluntarily provided by THE CLIENT in the REGISTRATION section.

Dlived.com guarantees that the CLIENT's personal information is protected in accordance with international data protection regulations. The personal information provided by the CLIENT will not be disclosed to third parties, unless it must be revealed in compliance with a court order or legal requirements.

The CLIENT will be responsible for the truthfulness of the data provided, reserving Dlived.com the right to refuse or exclude registrations in which false or questionable data is detected.

The CLIENT of Dlived.com may be interested in receiving information about other related services and activities. If you do not wish to receive this information, you must send a message to the email address contacto@dlived.com with the Subject: REQUEST TO UNSUBSCRIBE FROM INFORMATION SERVICE.

Subscribing to promotional email newsletters is voluntary and can be selected when creating your account.

Prices and payment methods

The prices of the products offered on Dlived.com are valid only for purchases made on this website.

The payment will be made using a VISA or MASTERCARD credit/debit card. If the card you use for your purchase is not in the currency of charge, the Issuing Bank of your card will apply the corresponding exchange rate.

If using other authorized and secure payment platforms available in the market, the CLIENT must contact "CUSTOMER SERVICE."

Payment cards are subject to validation checks and authorization from your card issuer. If we do not receive the required authorization, we will not be responsible for any delays or for failing to deliver your ORDER.

THE CUSTOMER declares that they have the legal right to use the acceptable payment method in relation to any ORDER.

Dlived.com reserves the right to change its prices at any time before accepting an ORDER.

Order delivery

On Dlived.com, the CLIENT will find the delivery options defined below:
  1. DELIVERY TO SUPPLIER WAREHOUSE
  2. LOGISTICS CENTER DELIVERY
  3. HOME DELIVERY

Home deliveries will have an additional cost that varies depending on the CLIENT's place of residence. The delivery price is detailed at the time of purchase by the CLIENT.

The delivery times begin to count from the sending of the confirmation and approval email of the ORDER and in accordance with the delivery methods defined within a period of 2 to 5 business days, which will be duly detailed in the invoice issued to THE CLIENT.

The information provided by the CLIENT in their order must include the personal details of the recipient, such as their name, phone number, email address, and delivery address; otherwise, the order may be held until the CLIENT corrects the information.

Dlived.com reserves the right to cancel orders with insufficient information without the right to a refund.

The CUSTOMER or RECIPIENT of the ORDER, as applicable, must check the external condition of the package and the products at the time of delivery.

In places where transit is impossible due to the deterioration of the streets or the lack of access roads, delivery will be made at the nearest location to the delivery address.

The RECIPIENT of the order will receive the shipment within the established timeframe according to the defined location after the confirmation and approval of the PURCHASE, signing the corresponding DELIVERY DOCUMENT as proof of receipt. The RECIPIENT of the ORDER must thoroughly review it before signing the DELIVERY REPORT.

If the RECIPIENT is not present at the address at the time of delivery, a second attempt will be made. If the situation persists for a second time, Dlived.com will contact the CUSTOMER to request a change of the RECIPIENT or the CANCELLATION of the ORDER.

Mandatory procedure in case of missing or damaged product (Any delivery method)

The CUSTOMER or, if applicable, the RECIPIENT of the ORDER must report the absence or degradation of the product to the "CUSTOMER SERVICE" of Dlived.com. The "CUSTOMER SERVICE" of Dlived.com may request any information related to the identity of the CUSTOMER or RECIPIENT of the ORDER and proceed with any necessary verifications for the case.

Dlived.com recommends that the CLIENT verify that they have received the entirety of their ORDER at the time of DELIVERY. In case of any discrepancies, they should refuse the DELIVERY and indicate it to the distributor at that moment.

Cancellations and refunds

To request a partial or full REFUND, the CUSTOMER must contact the "CUSTOMER SERVICE" team by communicating via the official email of Dlived.com.

The processing of CANCELLATIONS and RETURNS is done through the digital store email contacto@dlived.com within a timeframe that will not exceed 24 hours.

Only cancellations of complete orders will be accepted prior to delivery at the destination; in particular cases, they must be consulted individually with "CUSTOMER SERVICE."

When making a CANCELLATION and RETURN request, the CUSTOMER is obligated, in applicable cases, to inform the RECIPIENT of the PURCHASE, so that they do not accept those products.

If a CANCELLATION request is made and the RECIPIENT has received the products, they must return them in their original packaging, sealed and in perfect condition, just as they were received. Otherwise, the REFUND of the balance will not be processed.

Dlived.com will indicate the refund of money to the CLIENT within 72 hours after the date on which Dlived.com receives the returned products. Dlived.com will process the REFUND using the same payment method that the CUSTOMER used to make the PURCHASE. The CUSTOMER will not incur any fees for this REFUND.

Likewise, when a refund is applicable, the amount will be returned to THE CUSTOMER in the same currency used for the purchase of the product and/or service. The exchange rate imposed by the issuing bank of the card in question will apply to this value. Dlived.com will not be responsible in any case for the difference, whether an increase or decrease, that THE CUSTOMER receives in the refund.

Dlived.com reserves the right to REJECT or CANCEL your ORDER at any time for certain reasons, including, but not limited to, the following:

Products availability

ERRORS in the description or prices of the Goods

ERRORS in Your ORDER

THE CUSTOMER will not have the right to cancel a DELIVERY ORDER for the following PRODUCTS:
  • Clearly customized products or made according to your specifications.
  • PRODUCTS whose nature renders them ineligible for return, deteriorate quickly, or are already expired.
  • PRODUCTS not suitable for RETURN for health or hygiene reasons and that were not sealed after being received.
  • PRODUCTS whose nature, after being delivered, became inseparably mixed with other PRODUCTS.

All claims regarding the PRODUCTS purchased must be processed electronically at contacto@dlived.com or through the "ONLINE CUSTOMER SUPPORT" available on the site or via WhatsApp.

If the CLIENT is interested in making a claim for the reasons provided in the CANCELATIONS AND REFUNDS section, they must first contact Dlived.com through the communication channels established above and request, if applicable, the corresponding refund. In the case of claims that result in RETROCHARGES (CBK), the CLIENT's account will be disabled until the process is concluded. To reactivate it, the CLIENT is obligated to pay in advance the costs arising from the claims process.

Fraud check

Dlived.com maintains a zero-tolerance policy against any manifestation of fraud as an essential principle to guarantee our CLIENT a safe SHOPPING environment.

Dlived.com reserves the right to suspend or cancel the execution and delivery of an ORDER, regardless of its nature and degree of execution, in the event of fraud, whether completed or attempted.

The order from THE CLIENT may be delayed for fraud verification. It may also be suspended for a longer period for a more thorough investigation to prevent fraudulent transactions.

The CLIENT and/or RECIPIENT are warned that they may be subject to legal proceedings in the event of claims initiated due to CHARGEBACKS related to fraud.

In the context of the fight against INTERNET FRAUD, the data related to the CUSTOMER's ORDER may be communicated to third parties authorized by law or designated by Dlived.com, solely for the purpose of verifying the CUSTOMER's identity, as well as the validity of the ORDER, the payment method used, and the expected delivery.

Warranty policy

It is understood that the PRODUCTS are in accordance with the CONTRACT as long as they conform to the description provided by Dlived.com and possess the qualities we have presented on this website, are suitable for the uses to which products of the same type are ordinarily intended, and exhibit the usual quality and performance of a product of the same type that can be reasonably expected. In this regard, if any of the PRODUCTS do not conform to the CONTRACT, you must inform us through any of the communication methods provided for this purpose.

All PRODUCTS for sale on Dlived.com are covered by the legal warranty of conformity (in accordance with applicable regulations) and by the warranty against hidden defects (in accordance with applicable regulations), which allows the CUSTOMER to RETURN defective or non-conforming products delivered to them at no cost.

Exclusion of warranties

The WARRANTY does not cover PRODUCTS that have been modified, repaired, integrated, or added by the CUSTOMER. The warranty will not cover apparent defects. The WARRANTY does not apply to PRODUCTS that have suffered deterioration as a result of misuse.

Consequences of the execution of guarantees

In the context of the LEGAL WARRANTY OF CONFORMITY, Dlived.com commits, at the CLIENT's choice:
  • to replace the PRODUCT with another identical one based on available stock.
  • to refund the PRICE of the PRODUCT when its replacement is impossible.

Retention of ownership

Dlived.com retains full and complete ownership of the PRODUCTS sold until the full payment of the PRICE is verified, including both the principal and any other mandatory expenses.

Intellectual property

The set of brands, whether figurative or not, and any illustrations, images, logos, and any content present on Dlived.com (including, by way of example and in no way exhaustive, the "GENERAL TERMS OF USE") are and will remain the exclusive property of Dlived.com, its partners, or the holder of the corresponding intellectual property rights.

Reproduction, in whole or in part, modification, or use of such trademarks, illustrations, images, and logos, or any other content from Dlived.com, is prohibited for any reason and on any medium, without the prior and express written consent of Dlived.com or the holder of the corresponding intellectual property rights. The above provision shall also apply to copyrights, designs and models, and patents present on the Website and/or used therein.

Limitation of liability

The responsibility of Dlived.com for the obligations established in these "GENERAL TERMS OF USE" cannot be enforced when the breach of such obligations is attributable to the actions of third parties, even when such actions were foreseeable, to the fault of the CLIENT, or due to the occurrence of a force majeure circumstance, as defined in the applicable jurisdiction, or any other circumstances that reasonably escape the exclusive control of Dlived.com.

The information available on the Website is provided without any warranty, either implied or express, regarding its completeness, accuracy, timeliness, non-infringement, availability, reliability, or exhaustiveness of the data, products, accessories, or services appearing on the website or regarding their suitability for the use that the CLIENT intends to make of them.

Dlived.com disclaims all responsibility for direct and indirect damages, foreseeable or not, suffered as a result of the use of the Website. In the event that liability is established for damages incurred by the CLIENT solely attributable to the placement of an Order, such liability will be limited to the amount of the ORDER that the CLIENT has paid.

To the maximum extent permitted by applicable law, in no event shall Dlived.com or its PROVIDERS be liable for any special, incidental, indirect, or consequential damages of any kind (including, but not limited to, damages for lost profits, loss of data or other information, business interruption, personal injury, loss of privacy arising from or in any way related to the use or inability to use the service, third-party software and/or third-party hardware used with the SERVICE, or otherwise in connection with any provision of these TERMS), even if Dlived.com or any PROVIDER has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some places do not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, which means that the above limitations may not apply. In these places, each party's liability will be limited to the fullest extent permitted by law.

Penalties

Islagrande.com and its affiliates, nor its directors to their knowledge, are controlled by any person and/or entity that is currently subject to any sanctions imposed by the United States of America, the Office of Foreign Assets Control (OFAC) of the Department of the Treasury, the United Nations Security Council, the European Union, or any other validly recognized and relevant sanctioning authority (collectively, Sanctions).
